Terms of use
These terms govern your access to cutis.health and the Cutis Health screening product (together, the "Service"), operated by Cutis Health, Inc. ("Cutis," "we," "us"). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
1. What Cutis is, and what it is not
Cutis is a skin-health screening and triage tool. The product analyses the appearance of skin lesions and surface conditions from smartphone photos, and returns a calibrated triage suggestion across four tiers: self-care, monitor, routine dermatologist visit, or urgent same-day care.
Cutis is not a medical device, a diagnostic service, or a substitute for professional medical advice. The Service does not diagnose disease, prescribe treatment, or replace evaluation by a qualified clinician. When the Service indicates a higher level of concern, your follow-up care is delivered by a board-certified dermatologist via our partner platforms — not by Cutis.
Always seek the advice of a qualified clinician for any question you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or saw inside Cutis.
2. Eligibility
You must be at least 18 years old, or 13 with the active supervision of a parent or guardian, to use the Service. By creating an account, you confirm that you meet these requirements.
3. Your account
- You are responsible for keeping your account credentials confidential.
- You agree to provide accurate information at signup and to update it if it changes.
- You may not share an account or use someone else's account.
- We may suspend or close accounts that are inactive, fraudulent, or used in violation of these terms.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to facilitate illegal activity.
- Submit photographs of other people without their consent.
- Submit content that is sexually explicit, abusive, or designed to mislead.
- Scrape, mirror, or reverse-engineer the Service or its underlying models.
- Attempt to interfere with the security or integrity of the Service.
- Use the Service to provide a competing screening or diagnostic offering.
- Misrepresent your relationship with Cutis or with any partner clinician.
5. The triage result you receive
The Service returns an urgency tier, a confidence band, and a recommended action. The result is a screening signal, not a diagnosis. Confidence is reported as calibrated probability bands and may be low. When the model is not sufficiently confident, it abstains and routes you to a clinician rather than guess.
Results may be wrong. You should treat any urgent recommendation as a reason to seek care; you should not treat a self-care recommendation as a reason to ignore worsening symptoms. If a concern is changing rapidly, bleeding, or otherwise worrying you, seek care regardless of what the Service says.
6. Partner dermatologists
When the Service offers to route you to a partner teledermatology platform, the partner operates under its own terms and privacy notice. The partner provides the clinical consult and any resulting diagnosis. Cutis facilitates the hand-off; we do not deliver clinical care.
Standard teledermatology fees may apply to a partner consult. Cutis may receive a referral fee from the partner. This relationship does not influence the triage result the Service gave you; we surface a partner connection on the same criteria regardless of whether a referral fee applies.
7. Consent and data
Your use of the Service is governed by our Privacy Policy. Inside the product, your consent for downstream uses of your scan is recorded in three independently revocable buckets — see the Privacy Policy, Section 4 — and you control them at any time.
8. Intellectual property
The Service, including its software, models, design, and content, is owned by Cutis or licensed to us. We grant you a limited, personal, non-transferable, revocable licence to use the Service in accordance with these terms.
You keep all rights in the photographs and information you submit. By using the Service, you grant Cutis a limited licence to process your content for the purpose of delivering the Service to you. Any broader use — for model improvement, research, or external sharing — requires the corresponding consent bucket described in the Privacy Policy.
9. Pricing
Screening through the Service is free. Partner-dermatologist consults are billed by the partner platform at their published rates. Optional premium features (when available) are billed at the rate disclosed in-app at the time of purchase. We may change pricing with reasonable notice; changes do not apply retroactively to consumed periods.
10. Service availability
We aim for high uptime but do not guarantee uninterrupted service. Maintenance, upgrades, outages of upstream providers, and other events may make the Service temporarily unavailable. The Service is provided "as is" and "as available."
11. Changes to the Service
We update our software, models, and triage thresholds regularly. Every model release is gated on a fixed evaluation suite including per-Fitzpatrick performance. A regression on any Fitzpatrick subgroup blocks rollout automatically. Each release is documented in a model card.
12. Termination
You can stop using the Service at any time and delete your account from within the app, or by emailing privacy@cutis.health. We may suspend or terminate access for a serious or repeated breach of these terms. Sections that by their nature survive (intellectual property, disclaimers, limitations of liability, dispute resolution) remain in effect after termination.
13. Disclaimers
To the maximum extent permitted by law, Cutis disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate in any particular instance.
14. Limitation of liability
To the maximum extent permitted by law, Cutis and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid Cutis in the twelve months preceding the claim, and (b) one hundred US dollars (USD 100).
Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
15. Indemnity
You agree to indemnify and hold Cutis harmless from any claim, loss, or expense arising out of your use of the Service in violation of these terms or any applicable law.
16. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes arising under these terms will be resolved in the state and federal courts located in Delaware, except where a consumer-protection statute in your jurisdiction grants you the right to bring a claim locally.
17. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes are surfaced in-app, and your continued use of the Service after the change constitutes acceptance.
